Implementation of reform "from scratch" to improve efficiency of business environment regulation — Prime Minister of Kazakhstan

At the government session chaired by the Prime Minister Alikhan Smailov, issues of implementing the approaches to regulating entrepreneurship "from scratch" were discussed.

Presentations were made by the Minister of National Economy Alibek Kuantyrov, acting Chair of the Board of NCE Atameken Nariman Abilshaikov.

On Dec. 30, 2021, the Head of State signed the Law on the implementation of a new regulatory policy in the field of entrepreneurial activity in the Republic of Kazakhstan. The list of legal acts, the adoption of which is necessary to ensure the operation of the Law, includes 164 legal acts.

New forms of state control will include a transition from inspections to preventive measures. Within the framework of the Law, legislative consolidation of the norm for automating the risk management system, which ensures minimal human participation in the formation of schedules for inspections and preventive control, is ensured.

The government was instructed to ensure the high-quality implementation of approaches in order to reduce the requirements of government agencies for business. At the moment, over 40% of the requirements do not correspond to the new approaches.

The implementation of the reform "from scratch" will improve the efficiency of regulation of the business environment and create favorable and stimulating conditions for enhancing entrepreneurship. Businesses will certainly feel a reduction in the administrative burden. To do this, it is necessary to ensure the creation and quality formation of the Register of Mandatory Requirements.

The Prime Minister of the Republic of Kazakhstan instructed the Ministry of National Economy, together with the Atameken Chamber, to approve the work schedule for the formation of the Register of Mandatory Requirements in accordance with the new “clean slate” regulatory approaches.

“The Ministry of Finance, together with the Ministry of Justice, within the framework of budget clarification, should provide funds for the creation of the Register based on the Adilet information system,” Smailov said.

The Prime Minister of the Republic of Kazakhstan also noted that, in accordance with the adopted law, it is necessary to revise and evaluate the previously existing regulatory acts for their compliance with the new basic approaches. All interested state bodies were entrusted with until July 1 of this year. to ensure the revision of these acts.

“It is necessary to automate the system of state control and business reporting. Therefore, I instruct the ministries of digital development and the national economy, together with the Legal Statistics Committee of the General Prosecutor's Office, to take the necessary measures to automate this system,” the Prime Minister of the Republic of Kazakhstan concluded.
