Government approved a list of state functions for transfer to a competitive environment

Today, during the meeting of the Government of the Republic of Kazakhstan, the relevant draft law "On Amendments and Additions to Certain Legislative Acts of the Republic of Kazakhstan on Transferring State Functions to a Competitive Environment" developed in pursuance of the 97th step of the Nation’s Plan “100 Concrete Steps” was considered.

The Minister of National Economy Timur Suleimenov reported that the amendments envisaged within the framework of the draft law can be divided into two parts: the first is the consolidation of basic approaches for transferring state functions to the competitive environment and the second is to amend the results of work with the first group of functions to be transferred.

The key provisions of the draft law are: the goals, principles and methods of transferring the functions of state bodies to a competitive environment, the criteria, the algorithm for selecting and transferring functions, monitoring the quality of the implementation of functions and the mechanism for their return, the rights and obligations of performers and potential performers of functions, etc.

It was noted that functions aimed at protecting national, information security, defense, protection of public order, constitutional order, human rights and freedoms, justice are not considered for transfer to a competitive environment.

To timely inform citizens about the ongoing work on transferring the functions of state bodies to a competitive environment, the websites of the MNE and the Atameken NCE will post and update all necessary information about the transferred functions.

To date, the proposed algorithm consists of seven main stages: the annual selection of functions of state bodies, the approval of the preliminary list of functions by the Commission under the Government, public discussion, the analysis of market readiness and analysis of regulatory impact, the approval of the list of transferred functions, legislative consolidation of proposals and monitoring of the implementation of functions of the state bodies in a competitive environment.

"The proposed approach will allow to ensure qualitatively the transfer of functions to a competitive environment," T. Suleimenov emphasized.

Based on the results of the work on the first group of functions, they were approved for transfer to a competitive environment and to self-regulating organizations: groups of functions of the Ministry of Justice regulating valuation activities; groups of functions of the Ministry of Energy regulating environmental activities; functions of the Ministry of Healthcare to determine the degree of satisfaction of citizens with the level and quality of provided medical care.
