The draft Code "On Customs Regulation in the Republic of Kazakhstan" was presented by the Minister of National Economy Timur Suleimenov today at the meeting of the Government chaired by the Prime Minister Bakytzhan Sagintayev.
"Over the past three years, a lot of work has been done on the site of the Eurasian Economic Commission to form a new Customs Code of EurAsEC, which is currently undergoing ratification procedures," T. Suleimenov said.
The new Community Code has been significantly revised, the main approaches to customs regulation have been revised. In this regard, the question arose about bringing the current national customs legislation in compliance with the new customs rules. The result of the eight-month work was a new draft of the Customs Code.
The main difference of the new Customs Code from the current customs legislation is a fundamentally new approach to customs regulation. The main principle of the new regulation is the automation of business processes at customs.
In addition to the emphasis on information technology, the Code for participants in foreign economic activities has a number of opportunities that allow them to optimize their expenses.
For investors, the opportunities for the release of goods have been expanded prior to the filing of a customs declaration. As part of the implementation of investment projects, investors will be able to take goods on the basis of an application with a subsequent filing of a declaration no later than the 10th day of the following month. This norm also applies to the customs procedures of a free warehouse, free customs zone, and processing.
In addition, a number of provisions of the Customs Code of Kazakhstan synchronizes the processes with the Tax Code of Kazakhstan. This concerns the provisions for accounting, offsetting (refunding) customs duties and taxes, as well as collecting debts and appealing notifications of violations and the results of the audit.
Simultaneously with the new Code, an accompanying bill was drafted that includes amendments to a number of Codes and laws.
In addition, amendments are made to the Environmental Code of the Republic of Kazakhstan with regard to issuing state environmental expertise for placing goods under the customs procedure of destruction. The Budget Code is being amended in the part of the rules regulation on advance payments. Also, amendments are made to some laws regarding the transfer of the transport control function and others.
"Thus, it can be stated that the new Customs Code will allow Kazakhstan to use transit and export potential, facilitate the conduct of foreign economic activity," T. Suleimenov concluded.
The Prime Minister of the Republic of Kazakhstan Bakytzhan Sagintayev instructed state bodies to study all the comments that were made during the meeting and, if necessary, to make changes.
