Legislative Review Launched in Kazakhstan as Part of the Implementation of the New Constitution

Minister of Justice Yerlan Sarsembayev reported at the Government session on measures for the implementation of the provisions of the new Constitution of the Republic of Kazakhstan.

The Head of the Ministry emphasized that the adopted novelties transform the institutional framework of the country, forming a human-centered model of governance in which the highest value is the rights and freedoms of the individual. According to the Minister, the implementation of the Basic Law requires a profound rethinking of the entire body of current legislation.

A phased approach has been proposed to ensure a high-quality transition. Priority measures include the development and submission to the Mazhilis of a package of amendments necessary for the functioning of state institutions, the conduct of elections to the Kurultai and the protection of the constitutional order. The Minister noted that the people of Kazakhstan are now enshrined as the sole bearer not only of power but also of sovereignty, which requires strengthening legal mechanisms for protecting state independence and territorial integrity.

Particular emphasis in the report was placed on strengthening the personal rights of citizens. Yerlan Sarsembayev highlighted several key areas:

  • Protection of housing: In accordance with the поручение of the Head of State, guarantees now extend not only to the prohibition of arbitrary deprivation of housing, but also to eviction, which will be possible only in exceptional cases by court decision.
  • Digital privacy: The Constitution significantly strengthens the protection of personal data in the digital era and guarantees the inviolability of private life when applying procedural measures.
  • Miranda rule: At the constitutional level, the obligation is established to explain rights to a detained person at the very moment of the actual restriction of freedom of movement, rather than several hours later.

As part of the implementation of the Presidential Decree on the execution of the Constitution, work has begun on five standalone constitutional laws. In total, eight constitutional laws and more than 60 general laws and codes are subject to revision.

The Minister of Justice also proposed approving a comprehensive Action Plan for the legislative implementation of the Constitution. The document provides for a full-scale review of all draft laws currently under consideration in Parliament to ensure their compliance with the spirit of the new Constitution. Together with state bodies, large-scale information and explanatory work will be carried out among the population so that every citizen clearly understands their new constitutional guarantees.
