At the Government session chaired by Prime Minister of the Republic of Kazakhstan Olzhas Bektenov, measures for the implementation of the provisions of the new Constitution were considered.
Reports were delivered by Deputy Prime Ministers – Minister of Culture and Information Aida Balaeva, Minister of Artificial Intelligence and Digital Development Zhaslan Madiyev, Minister of National Economy Serik Zhumangarin, as well as Minister of Education Zhuldyz Suleimenova, Minister of Science and Higher Education Sayasat Nurbek, Minister of Ecology and Natural Resources Yerlan Nysanbayev, Minister of Internal Affairs Yerzhan Sadenov and Minister of Justice Yerlan Sarsembayev.
The Prime Minister congratulated Kazakhstanis on the adoption of the new Constitution at the nationwide referendum, emphasizing the historical significance of this event for the country.
“First of all, I congratulate all Kazakhstanis on this historic event – the adoption of the new Constitution at the nationwide referendum! This is a pivotal moment in the modern history of Kazakhstan. The comprehensive transformation of our country carried out under the leadership of the Head of State Kassym-Jomart Tokayev, with the active support of society, is making Kazakhstan more resilient to any challenges. The Basic Law of the country will strengthen political stability and will enable further modernization of all sectors of the economy and society,” Olzhas Bektenov emphasized.
It was noted that the new Constitution defines the future of the nation for the long term, laying down the fundamental postulates of unity and justice, law and order, guarantees the protection of the rights and freedoms of citizens, conditions for the qualitative development of human capital, science and culture, the digital environment, and ensuring environmental safety. An important aspect is the strengthening of the principles of the rule of law through broad procedural rights, as well as the enshrinement of the constitutional right to legal assistance and the protection of personal data.
“As the President noted, the new Constitution will become a reliable foundation of our statehood, Sovereignty and Independence. Through their votes, Kazakhstanis demonstrated genuine patriotism by supporting all initiatives of the Head of State. We are witnessing recognition by the international community of the leadership of Kassym-Jomart Tokayev and the progressive nature of the adopted Constitution. This underscores Kazakhstan’s high authority and the success of the ongoing reforms,” the Prime Minister emphasized.
In terms of legislative support for the reforms, the Government, together with Parliament, will promptly bring a number of laws and subordinate acts into compliance with the new Constitution. It is planned to ensure the adoption of five new and the adjustment of eight existing constitutional laws, as well as amendments to more than 60 laws, including codes. In addition, an Action Plan for promoting the Constitution will be developed and approved, which предусматривает its mass publication, placement on publicly accessible electronic platforms, and the development of methodological recommendations and учебных пособий for the education sector. Information and explanatory work on the new Basic Law of the country will also be intensified.
Olzhas Bektenov noted that, in general, the new Constitution provides for and enshrines all the key norms and rules that create a solid foundation for the progressive development of the state and society.
During the meeting, Head of the Government gave a number of instructions to the responsible state bodies.
The Ministry of Culture and Information was instructed to develop, within one week, a plan of information and explanatory work on the provisions of the Constitution. By 10 April, it is necessary to ensure the mass publication of the Basic Law and its distribution among state bodies, educational and cultural institutions, library networks and retail outlets. The Ministry of Digital Development was also instructed to ensure the placement of the text of the Constitution on publicly accessible electronic platforms.
On education:
The Ministry of Education, the Ministry of Science and Higher Education were instructed to develop methodological recommendations and teaching materials by 20 April, as well as to organize training sessions on the Constitution in educational institutions.
On healthcare:
The Ministry of Healthcare, together with the Ministry of Justice, was instructed to submit amendments to the legislation to Parliament by 1 April, taking into account the expansion of sources of financing for medical care, including off-budget funds, which will make the system more sustainable and flexible. The insurance package will become the main instrument for access to most types of planned and high-tech medical care.
On labour and social protection:
The Ministry of Labour and Social Protection of the Population is also required, by 1 April, to introduce amendments to the Social and Labour Codes, taking into account the development of the digital economy and new forms of employment, including remote and platform-based work.
On ecology:
By the same deadline, the Ministry of Ecology was instructed to introduce amendments to the Environmental Code as part of the implementation of environmental protection principles and the President’s initiative “Taza Kazakhstan”. Provisions on environmental protection and careful attitude to nature are now enshrined at the constitutional level, while environmental responsibility becomes a fundamental constitutional principle with real legal obligations.
On digital development:
The new Constitution enshrines the protection of personal data, to which the Head of State attaches particular importance in the context of the active implementation of digital technologies and artificial intelligence. The Ministry of Artificial Intelligence and Digital Development was instructed to strengthen control mechanisms in this area and accelerate the development of the necessary legislative amendments.
On law and order and security:
One of the key postulates of the new Constitution is the principle of “Law and Order”. In this regard, the Ministry of Internal Affairs will need to conduct an analysis of the implementation of “Law and Order”, ensure the annual publication of the results in the National Report on the State of Public Safety, and organize, by the end of April, a meeting of the Interdepartmental Commission on the Prevention of Offenses in an updated format.
On amnesty:
Special attention was paid to the issue of amnesty for a number of offenses, initiated for the first time by the Head of State, that do not pose a threat to the safety of citizens and the state. The Ministry of Internal Affairs and the Ministry of Justice, together with the General Prosecutor’s Office, are to submit proposals on the mechanism for its implementation within two weeks.
On legislative work:
The Ministry of National Economy, together with interested state bodies, was instructed to develop and submit to the Government by 15 April draft constitutional laws “On the Administrative-Territorial Structure of the Republic of Kazakhstan” and “On the Status of the Capital of the Republic of Kazakhstan”. The task was set to accelerate the consideration in Parliament of the draft constitutional law “On the Special Status of the City of Alatau” with its submission for signing to the Head of State by the end of March.
As part of the implementation of the Presidential Decree “On measures for the implementation of the Constitution of the Republic of Kazakhstan”, the Ministry of Justice was instructed to submit, by 1 April, a draft Action Plan for the promotion of the new Constitution, with subsequent approval of the document by 7 April.
In general, the Prime Minister emphasized that all central and local state bodies, as well as the quasi-public sector, must take comprehensive measures to implement the Plan.
